TERMS OF USE

These Terms of Use govern your access to zkbears.xyz, the ZKBEARS whitelist, and related features operated by the ZKBEARS project team (collectively, “ZKBEARS,” “we,” “us,” or “our”). By using the website or submitting a whitelist entry, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not submit an entry.

1. Eligibility

You must be at least 18 years old and legally able to enter into these Terms. You may use the website only where doing so is lawful. You are responsible for complying with laws that apply to you.

2. Whitelist

• A saved whitelist spot records your request to participate. It does not guarantee eligibility, an allocation, a mint, an NFT, a particular price, timing, rarity, value, or future benefit.
• Complete the steps shown on the website in order. Some task completion markers record that you opened an external X page; they do not independently verify activity performed on X.
• Only one whitelist entry may use a particular Zcash Unified Address. Once an address is saved, it cannot be replaced through the website.
• Automated submissions, duplicate entries, attempts to bypass limits, interference with the service, and false or abusive activity are prohibited. We may reject or remove affected entries.
• We may modify, pause, or close the whitelist when reasonably necessary, including for security, technical, legal, or operational reasons.

3. Wallet connection

The website uses the Noir Wallet browser extension to request a Zcash Unified Address. ZKBEARS is non-custodial: we do not control your wallet or funds and do not request or store your seed phrase, private keys, or spending keys. Never provide those credentials to anyone claiming to represent ZKBEARS. You are responsible for your wallet, device, backups, and any blockchain transaction you choose to make.

4. X and other third-party services

X authorization is provided by X. ZKBEARS does not receive your X password and does not follow accounts, like posts, repost content, or publish content on your behalf. Any action you take after opening X is voluntary. Noir Wallet, X, Cloudflare, GitHub, Google, and other third-party services operate under their own terms and privacy policies. ZKBEARS does not control and is not responsible for those services. References to third parties do not imply sponsorship or endorsement.

5. Collection information and digital-asset risk

Artwork, traits, supply, availability, roadmap, release details, mint mechanics, and other collection information may change before release. Website content is provided for general information and is not a binding promise of future features or value. Digital assets and blockchain services may be volatile, experimental, unavailable, or affected by technical, regulatory, market, and security risks. You assume the risks of any decision you make.

6. Intellectual property

The ZKBEARS name, artwork, graphics, code, and website content are owned by or licensed to their respective rights holders and are protected by applicable intellectual-property laws. These Terms do not grant you a license to copy, modify, distribute, commercialize, or create derivative works from that material. Any rights associated with a future NFT will be stated in a separate collection license made available for the relevant release.

7. No financial advice

Nothing on the website is financial, investment, legal, accounting, or tax advice, or an offer or solicitation to buy or sell an investment. Obtain independent professional advice where appropriate.

8. Availability and disclaimers

To the fullest extent permitted by law, the website and whitelist are provided “as is” and “as available.” We do not guarantee uninterrupted operation, error-free data, compatibility with every wallet or device, continued availability of external services, or that the website will meet your expectations. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

9. Limitation of liability

To the fullest extent permitted by law, ZKBEARS and its contributors will not be liable for indirect, incidental, special, consequential, or punitive loss, loss of profits or opportunity, loss of data, wallet compromise, blockchain failure, or loss caused by a third-party service. This limitation does not apply where liability cannot legally be limited, including liability arising from fraud or willful misconduct.

10. Suspension and termination

We may suspend access or remove an entry where we reasonably believe these Terms were violated, the service is being abused, or action is required to protect users, the project, or the website. You may stop using the service at any time and may request deletion as described in the Privacy Policy.

11. Privacy

Our Privacy Policy explains what information is collected, why it is used, how long it is kept, and how to request access or deletion.

12. Changes to these Terms

We may update these Terms when the project or applicable requirements change. The “Last updated” date identifies the current version. Material changes will be presented on the website before they apply to new whitelist submissions. Your continued use after an update constitutes acceptance only to the extent permitted by applicable law.

13. Applicable law and disputes

Applicable mandatory consumer and data-protection laws remain unaffected. Before starting formal proceedings, please contact us so we can try to resolve the issue informally. Nothing in these Terms limits a right to bring a claim or complaint before a competent court or authority where that right cannot be waived.
